Councilmember Romero introduced the following: RESOLUTION NUMBER 14.22.23R A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF ALBANY URGING NEW YORK STATE TO FUND AND IMPLEMENT A PERMANENT UNIVERSAL FREE SCHOOL MEAL PROGRAM, K-12 WHEREAS, food insecurity is defined by the US Department of Health and Human Services as having reduced or uncertain access to adequate food. Food security, or a lack thereof, is a primary social determinant of health; and WHEREAS, according to the NY Health Foundation, prior to the COVID-19 pandemic, around 10% of New Yorkers were food insecure; and WHEREAS, child hunger is associated with increased risk of anemia, lower nutrient intake, deficiencies in cognitive development, aggression, anxiety, asthma, depression, suicidal ideation, and poor oral health; and WHEREAS, tackling food insecurity and food apartheid supports social and economic equity, and provides a vital investment in our youth who will become our future leaders; and WHEREAS, a federal program was implemented during COVID-19 to provide school districts a waiver to provide free lunch to all students, however, this program expired in June 2022; and WHEREAS, due to the Community Eligibility Provision (CEP) in federal aid, the Albany City School District has continued to provide free breakfast and lunch for all students; and WHEREAS, Hunger Solutions New York reports that households with students attending CEP schools were nearly three times less likely to be food insecure than households with students in CEP eligible schools that choose not to participate; and WHEREAS, in the City of Albany, there has been a sharp rise in food insecurity since the start of the COVID-19 pandemic. A recent report issued by SUNY Albany’s School of Public Health shows that 70% of Black and Hispanic Capital Region households experienced food insecurity since the outbreak began; and WHEREAS, correlations between childhood hunger and effects on absenteeism, scholastic performance and behavioral issues are well documented; and WHEREAS, the estimated cost to New York State will be offset with federal aid, decreased strain on the healthcare system, and increased long-term productivity; and WHEREAS, a universal free meal program will eliminate the current $24.9 million per year unpaid school meal debt, save families an estimated $140 per child in grocery spending each month, and eliminate the stigma associated with receiving this public assistance; and WHEREAS, a permanent universal free school meal program will restore food access to over 700,000 students in New York State; NOW, THEREFORE BE IT RESOLVED, that the Common Council of the City of Albany urge the New York State to fully fund a permanent universal free school meal program; and BE IT FURTHER RESOLVED, that a copy of this resolution, suitably engrossed, be transmitted to Senator Neil Breslin, Assemblymember Patricia Fahy, Governor Hochul, Senate Majority Leader Stewart-Cousins, Assembly Speaker Heastie, the Senate Finance Committee, the Assembly Ways and Means Committee, and Assemblymember Jessica González-Rojas. Council Member Frederick, on behalf of the Finance, Taxation and Assessment Committee, introduced the following: LOCAL LAW N OF 2022 A LOCAL LAW AMENDING ARTICLE III (SENIOR CITIZENS TAX EXEMPTION) OF CHAPTER 333 (TAXATION) OF THE CODE OF THE CITY OF ALBANY TO INCREASE THE MAXIMUM INCOME ELIGIBILITY LEVELS APPLICABLE TO THE EXEMPTION Be it enacted by the Common Council of the City of Albany as follows: Section 1. Subsections (A) and (B) of section 333-34 (Eligibility) of Article III (Senior Citizens Tax Exemption) of Chapter 333 (Taxation) of Part II (General Legislation) of the Code of the City of Albany is hereby amended to read as follows: A. The real property tax exemption provided here on real property owned by husband and wife spouses, one of whom is 65 years of age or over, once granted, shall not be rescinded solely because of the death of the older spouse so long as the surviving spouse is at least 62 years of age. Section 2. Subsections (A) and (B) of Section 333-35 (Exceptions) of Article III (Senior Citizens Tax Exemption) of Chapter 333 (Taxation) of Part II (General Legislation of the Code of the City of Albany is hereby amended to read as follows: A. If the income of the owner or the combined income of the owners of the property for the income tax year immediately preceding the date of making application for exemption exceeds $37,400 $58,400. “Income tax year” shall mean the twelve-month period for which the owner or owners filed a federal personal income tax return or, if no such return is filed, the calendar year; where title is vested in either the husband or his wife spouse, their combined income may not exceed such sum. Such income shall include social security and retirement benefits, interest, dividends, total gain from the sale or exchange of a capital asset in the same income tax year, net rental income, salary or earnings and net income for self-employment, but shall not include a return of capital, gifts or inheritance. In computing net rental income and net income for self-employment, no depreciation deduction shall be allowed for the exhaustion, wear and tear of real or personal property held for the production of income. B. Unless the title of the property shall have been vested in the owner or one of the owners of the property for at least 24 consecutive months prior to the date of making application for exemption; provided, however, that in the event of the death of either a husband or wife spouse in whose name title of the property shall have been vested at the time of death and then becomes vested solely in the survivor by virtue of devise by or descent from the deceased husband or wife spouse, the time of ownership of the property by the deceased husband or wife spouse shall be deemed also a time of ownership by the survivor, and such ownership shall be deemed continuous for the purposes of computing such period of 24 consecutive months, provided further that in the event of a transfer by either a husband or wife spouse to the other spouse of all or part of the title to the property, the time of ownership of the property by the transferor spouse shall be deemed also a time of ownership by the transferee spouse, and such ownership shall be deemed continuous for the purpose of computing such period of 24 consecutive months, and provided further that where property of the owner or owners has been acquired to replace property formerly owned by such owner or owners and taken by eminent domain or other involuntary proceeding, except a tax sale, the period of ownership of the former property shall be combined with the period of ownership of the property for which application is made for exemption, and such periods of ownership shall be deemed to be consecutive for purposes of this section. Where a residence is sold and replaced with another within one year and both are located in the City of Albany, the period of ownership of the former shall be combined with the period of ownership of the replacement residence and deemed consecutive for exemption purposes. Section 3. This Local Law shall take effect upon final passage, public hearing, and filing with the Secretary of State and shall apply to assessment rolls prepared on the basis of taxable status dates occurring on and after January 1, 2023. The assessed value of property owned by qualifying seniors is, under these statutes, exempt from taxation at a sliding rate, dependent upon the owner(s)’ annual income. From 2009 until the enactment of the new state law earlier this year, if a qualifying property owner had an income of $29,000 or less per year, the property was exempt to 50% of its value, while qualifying owners with an income of up to $37,400 received a 5% exemption. By SB 3085, signed into law by Governor Hochul on August 8, 2022, and codified as chapter 488 of the laws of 2022, the Legislature amended RPTL § 467 to increase these eligibility amounts for the first time in thirteen years. Under the amended state law, qualifying owners bringing in up to $50,000 per year may enjoy a 50% exemption while those making up to $58,400 are entitled to an exemption of 5% of their property’s value. NECESSITY FOR LEGISLATION AND ANY CHANGE TO EXISTING LAW This local law brings the City of Albany’s exemption income eligibility levels in line with those recently authorized by the State. The local law will apply only to assessment rolls prepared on the basis of taxable status dates occurring on an after January 1, 2023. Thus, because of the way the assessment calendar is arranged under the real property tax law, the exemption will not be available to those who fall under the new eligibility brackets until the 2023-24 school tax bills and 2024 City/County tax bills. This local law also replaces the repeated uses of the phrase “husband and wife” present in the current version of the code with the more gender-neutral term “spouse.” FISCAL IMPACT The expansion of the income eligibility ranges for this exemption will mean that more seniors will be able to take advantage of it, which could have an exceedingly minimal impact on the homestead tax rate. NECESSITY FOR LEGISLATION AND CHANGES TO EXISTING LAW In 2020, the Federal Government completed the most recent census, providing more accurate population counts for the various areas within the City of Albany. These new numbers showed that the populations of the Wards were no longer mostly equal. This law replaces the old Wards and their boundaries with newer ones. These new lines were drawn by the City of Albany Redistricting (Reapportionment) Commission, which was mandated to consider the application of the “one person, one vote” concept and the equal protection clauses of the Fourteenth Amendment of the United States Constitution and Article I, Sections I and II of the New York State Constitution. Therefore, they have equal population and protect minority voting rights. These new boundaries will allow the Common Council to provide fairer representation to the people of Albany and ensure that no neighborhood is over or underrepresented. FISCAL IMPACT(S) None. Section 359-22 (Parking, standing and stopping restrictions) of Article II (Traffic Regulations) of Chapter 359 (Vehicles and Traffic) of Part II (General Legislation) of the Code of the City of Albany is hereby amended to read as follows: § 359-22 Parking, standing and stopping restrictions. Except as otherwise designated by official signs, signals or markings, the following restrictions will apply in the City of Albany. Except when necessary to avoid conflict with other traffic or when in compliance with law or the direction of a police officer or official traffic control device, no person shall: A. Stop, stand or park a vehicle: (1) On the roadway side of any vehicle stopped, standing or packed parked at the edge or curb of a street. (2) On a sidewalk. (3) Within an intersection, except when permitted by official signs or parking meters on the side of a highway opposite a street which intersects but does not cross such highway. (“Intersection” is defined as the area embraced within the prolongation or connection of the lateral curblines or, if none, then the lateral boundary lines of the roadways of two highways which join one another at, or approximately at, right angles, or the area within which vehicles traveling upon different highways joining at any other angle may come in conflict. Where a highway includes two roadways 30 feet or more apart, then every crossing of each roadway of such divided highway by an intersecting highway shall be regarded as a separate “intersection.”) In the even that such intersecting highway also included two highways 30 feet or more apart, then every crossing or two roadways of such highway shall be regarded as a separate intersection. (4) On a crosswalk. (5) Between a safety zone and the adjacent curb or within 30 feet of points on the curb immediately opposite the ends of a safety zone, unless a different distance is indicated by official signs, markings or where parking meters are installed. (7) Upon any bridge or other elevated structure upon a highway or within a highway tunnel, unless otherwise indicated by official signs, markings or where parking meters are installed. (8) On any railroad tracks. (9) In the area between roadways of a divided highway, including crossovers, except in an emergency. (10) On a state expressway, highway or state interstate route highway, including the entrances thereto and exits therefrom, which are a part thereof, except in an emergency. (11) In a space designated as provided in this subsection for the exclusive purpose of charging an electric vehicle at an electric vehicle charging station, unless such vehicle is an electric vehicle connected to such charging station; provided, however, that an electric vehicle disconnected from the electric vehicle charging station for no more than 45 continuous minutes while stopped, standing, or parked in such designated space shall not be in violation of this subsection. Parking spaces designated for the exclusive purpose of charging an electric vehicle at an electric vehicle charging station shall be clearly identified, and such designation shall include conspicuous and permanently installed signs or markings which identify such space as an electric vehicle charging station, indicate that such space is only for electric vehicle charging, and include any day or time restrictions. For the purposes of this subsection, the term "electric vehicle" shall mean a motor vehicle that is propelled at least in part by an electric motor and associated power electronics which provide acceleration torque to the drive wheels sometime during normal vehicle operations, and that draws electricity from a battery or hydrogen fuel cell that is capable of being recharged from an external source of electricity, such that the external source of electricity cannot be connected to the vehicle while the vehicle is in motion. For purposes of this subsection, the term "electric vehicle charging station" shall mean the equipment needed to convey electric power from the electric grid or another power source to an onboard motor vehicle energy storage system. For purposes of this subsection, "disconnected" shall mean not connected to the charging port of the electric vehicle. B. Stand or park a vehicle, whether occupied or not, except momentarily to pick up or discharge a passenger or passengers: (1) In front of a public or private driveway. (2) Within 20 feet of a crosswalk at an intersection unless a different distance is indicated by official signs, markings or where parking meters are installed. (4) Within 20 feet of a driveway entrance to any fire station and when on the side of the street opposite to the entrance of any fire station within 75 feet of said entrance, when properly sign-posted, unless a different distance is indicated by official signs, markings or where parking meters are installed. C. Park a vehicle, whether occupied or not, except temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers, within 50 feet of the nearest rail of a railroad crossing, unless a different distance is indicated by official signs, markings or where parking meters are installed. D. Stop, stand or park a vehicle within 15 feet of a fire hydrant except when such vehicle is attended by a licensed operator or chauffeur who is seated in the front seat and who can immediately move such vehicle in case of emergency, unless a different distance is indicated by official signs, markings or where parking meters are installed. E. Move a vehicle not lawfully under his control into any prohibited area or away from a curb such distance as is unlawful. F. Drive into or park such vehicle within the block where fire apparatus has stopped in answer to a fire alarm. G. Park a tow truck, as defined in § 353-50 of Chapter 353, with a vehicle in tow, on any street or park a tow truck without a vehicle in tow between the hours of 6:00 p.m. and 6:00 a.m. H. Park a trailer, including boat trailers, utility trailers and truck trailers, without being attached to a vehicle, on any City street. I. Conduct vehicle repairs parked on any City street, except for tire changes, batter replacement or changing, and replacing of fluids. J. Cause or permit the engine of a motor vehicle, other than a legally authorized emergency motor vehicle, a television transmission vehicle, or a vehicle whose operation even while standing requires a running engine, to idle for more than five minutes while parking, standing or stopping, except that a bus, as defined in § 104 of the Vehicle and Traffic Law, may idle while passengers are on board or while boarding or discharging passengers. K. Stand or park a tractor, as that term is defined in sections 151-a of the vehicle and traffic law, or any commercial vehicle weighing in excess of 10,000 pounds on any City street for a period of more than three consecutive hours, except for the purposes of actively loading Matter in strikethrough to be deleted. Corporation Counsel Re: Common Council Legislation Supporting Memorandum Date: December 23, 2022 Sponsor: Robinson ORDINANCE 1.11.23 TITLE AN ORDINANCE AMENDING CHAPTER 359 (VEHICLES AND TRAFFIC) OF THE CODE OF THE CITY OF ALBANY IN RELATION TO THE PARKING OF TRACTOR TRAILERS ON CITY STREETS GENERAL PURPOSE OF LEGISLATION Increasingly, tractor trailers have been using City streets in certain parts of the City for overnight parking, often with engines idling for hours at a time, causing unhealthy exhaust fumes to disperse into the local environment and neighboring residences. This legislation addresses this significant quality of life issue by limiting such vehicles from parking or standing on City streets for more than three hours, unless loading or unloading, which will prevent operators from parking and idling their vehicles overnight. NECESSITY FOR LEGISLATION AND ANY CHANGE TO EXISTING LAW The City Code currently prohibits “commercial vehicles weighing in excess of 10,000 pounds” from “operating and/or parking” on 51 certain enumerated City streets (or portions thereof), but parking of tractor trailers is currently generally allowed, subject to other relevant parking regulations, elsewhere in the City. This ordinance expands such a parking and standing ban to all City streets while allowing tractor trailers to remain parked for more than three hours only if they are being actively loaded or unloaded or if given special permission by APD. The Vehicle and Traffic which defines “tractor,” at § 151-a, as A motor vehicle designed and used as the power unit in combination with a semitrailer or trailer, or two such trailers in tandem. Any such motor vehicle shall not carry cargo except that a tractor and semitrailer engaged in the transportation of automobiles may transport motor vehicles on part of the power unit. He began his Christian journey in the Morning Star Missionary Baptist Church. In 1985 Pastor Taylor graduated from the Albany Business College and later would take classes at the Andersonville Theological Seminary and the Wise School of Ministry; and WHEREAS, Pastor Taylor began his ministerial training in 2006 under the Reverend Ronald Grant of Shiloh Baptist Church of Hudson where Pastor Taylor served as the executive minister to the pastor and the minister of music. Council Member Clarke introduced the following RESOLUTION NUMBER 9.21.23R A RESOLUTION OF THE COMMON COUNCIL HONORING THE LIFE OF BEVERLY BARDEQUEZ AND RENAMING A PORTION OF RAPP ROAD IN HER HONOR WHEREAS, Beverly Ann Bardequez was born on April 13, 1949 in Albany, NY, and was the daughter of the late Edward and Girlie Ferguson; and WHEREAS, upon graduation from New Lebanon Central High School she was employed by the New York State (NYS) Department of Social Services and later the NYS Department of Health, before leaving to pursue a Bachelor of Arts Degree from The State University of New York at Albany; and WHEREAS, upon her graduation, Beverly obtained employment with the Educational Opportunity Center, a Division of Hudson Valley Community College in Troy, NY, where she worked as the Enrollment Services Manager until her retirement; and WHEREAS, Beverly took pride in assuming her role as the President of the Rapp Road Historic Association formerly held by Emma Dickson and worked tirelessly to preserve the Rapp Road legacy; and WHEREAS, during her tenure as President, the “Crossroads: The History of Rapp Road and the Great Migration” documentary was featured on PBS, and the Rapp Road Historic Association walking tour was established; and WHEREAS, the Rapp Road Historic Association exhibit was featured and presented at many locations throughout New York State, including the New York State Museum; and WHEREAS, Beverly was recognized for her dedication to the association, receiving numerous citations and awards – most notably in 2003 when she was the recipient of the Chancellor’s Award; and WHEREAS, she has been posthumously awarded the Certificate of Special Congressional Recognition at the 11th Annual Mississippi Day Celebration on September 10, 2022 and received recognition from the Albany Common Council for her contributions to the city of Albany on October 17th, 2022; NOW, THEREFORE, BE IT RESOLVED, that the City of Albany honors the life and legacy of Beverly Bardequez and renames the portion of Rapp Road between South Frontage Road and Springsteen Road in her honor; and BE IT FURTHER RESOLVED, that the Common Council directs that two signs shall be produced reading “Beverly Bardequez Way,” which shall be placed in consultation with the Division of Traffic Engineering.
