NECESSITY FOR LEGISLATION AND CHANGES TO EXISTING LAW The sale of City-owned property requires Common Council approval. FISCAL IMPACT(S) 254 Livingston Avenue has an assessed value of $27,000. Council Member Frederick, on behalf of the Committee on Finance, Taxation, and Assessment, introduced the following: ORDINANCE 10.31.23 AN ORDINANCE AUTHORIZING CERTAIN PURCHASES BY THE CITY OF ALBANY, NEW YORK AT A MAXIMUM ESTIMATED COST OF $980,000.00 AND AUTHORIZING THE LEASE FINANCING OR THE ISSUANCE OF $980,000.00 SERIAL BONDS OF SAID CITY TO PAY THE COST THEREOF (PLANNING – SOUTH END CONNECTOR PHASE) The City of Albany, in Common Council convened, does hereby ordain and enact: Section 1. The objects or purposes to be authorized and financed pursuant to this ordinance are set forth below, together with estimates of the maximum estimated costs thereof; determinations of the periods of probable usefulness thereof and the subparagraphs of Section 11.00(a) of the New York Local Finance Law pursuant to which it is determined; the maximum amount of the bonds to be issued with respect to such object or purpose and the maximum term of the obligations to be issued with respect to each project or purpose. Pending the sale of the bonds herein authorized, the temporary use of funds from the City’s general fund, pursuant to the provisions of section 165.10 of the New York Local Finance Law, is hereby authorized. The City reasonably expects to reimburse such temporary expenditures with the proceeds of the bonds or bond anticipation notes authorized by Section 1 of this ordinance. This ordinance shall constitute the City’s “official intent” to reimburse such temporary expenditures in accordance with Untied States Treasury Regulation section 1.150-2. Section 5. The faith and credit of the City of Albany, New York, are hereby irrevocably pledged for the payment of the principal of and interest on such leases or bonds as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such leases or bonds becoming due and payable in such year and such debt service payments may be made in substantially level or declining amounts as may be authorized by law. There shall annually be levied on all taxable real property of said City, a tax sufficient to pay the principal of and interest on such leases or bonds as the same become due and payable. Section 6. Subject to the provisions of the New York Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated in the City Treasurer, as chief fiscal officer of the City of Albany. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said City Treasurer, consistent with the provisions of Local Finance Law. Section 7. The City Treasurer is further authorized to take such actions and execute such documents as may be necessary to ensure the continued status of the interest on the leases or bonds authorized by this resolution and any notes issued in anticipation thereof, as excludable from federal income taxation pursuant to Section 103 of the Internal Revenue Code of 1986, as amended (the “Code”) and to designate the bonds authorized by this resolution, and any notes issued in anticipation thereof as “qualified tax-exempt bonds” in accordance with Section 265(b)(3)(B)(i) of the Code. Section 8. The City Treasurer is further authorized to enter into a continuing disclosure agreement with the initial issuer of the leases or the purchaser of the bonds or notes authorized by this resolution, containing provisions which are satisfactory to such purchaser in compliance with the provisions of Rule 15c12-12, promulgated by the Securities and Exchange Commission, pursuant to the Securities and Exchange Act of 1934. Section 9. The validity of such leases or bonds and bond anticipation notes may be contested only if: (a) Such obligations are authorized for an object or purpose for which said City is not authorized to expend money, or (b) The provisions of law which should be complied with at the date of publication of this ordinance pursuant to Section 8 hereof are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or (c) Such obligations are authorized in violation of the provisions of the Constitution. Section 10. Upon this ordinance taking effect, the Clerk of the Common Council is hereby authorized and directed to publish the same together with a notice in substantially the form set forth in section 81.00 of the New York Local Finance Law. Section 11. It is hereby determined that except as hereinafter specified, the authority and funding of the projects aforesaid constitute either unlisted or Type II actions under the New York State Environmental Quality Review Act and the regulations promulgated thereunder having no adverse effect upon the environment. The Planning Department recently determined that it no longer needed the remaining $980,000 remaining in that bond account for Maiden Lane work, and that the funds could be better applied to further improvements to the South End Connector. This bond ordinance would authorize the Planning Department to use those funds for its continued work on the South End Connector NECESSITY FOR LEGISLATION AND ANY CHANGE TO EXISTING LAW Once a bond ordinance is passed, the Treasurer’s Office puts the bond out on the market, and the account authorized by the ordinance is funded, the original enabling ordinance cannot be amended to apply the funds to a new purpose. This ordinance, by authorizing a new, separate bond for South End Connector activities, will allow the left-over Maiden Lane funds to be used for that new purpose. FISCAL IMPACT None, as the funds are already available; they are simply legally constrained from being used for anything other than the Maiden Lane project at this time. Council Member Clarke introduced the following: Resolution Number 17.31.23R A RESOLUTION OF THE COMMON COUNCIL CONSENTING TO THE REMISSION OF INTEREST DUE ON 2023 PROPERTY TAX PAYMENTS FOR THOSE TAXPAYERS WHOSE PROPERTY TAX PAYMENTS WERE STOLEN FROM THE MAIL WHEREAS, certain property taxpayers have had their 2023 property tax checks stolen out of mailboxes or from the Post Office; an WHEREAS, some of these checks were modified by the thief or thieves such that “City of Albany” was removed as the payee with another entity or individual written in its place; and WHEREAS, some, but not all of these checks were stopped before being paid out, so that while the investigation into the fraud continues, certain affected taxpayers have lost their property tax payments, leaving them with no available resources to pay their tax bills; and WHEREAS, the extent of these thefts is still not known for certain, because banks may not have caught the fraud and brought it to the taxpayers’ or the City Treasurers’ attention; WHEREAS, Section 1182 of the New York State Real Property Tax Law (RPTL) authorizes the governing body of any tax district, if it shall determine that it is for the best interests of the tax district, to authorize the enforcing officer cancel, in whole or in part, any interest, penalties or other charges imposed by law to which the tax district or any other municipal corporation shall be lawfully entitled; and NOW, THEREFORE, BE IT RESOLVED, the Common Council of the City of Albany, as the municipal corporation affected, consents to the remission of interest as it pertains to those individuals whose 2023 property taxes, which were due to the City of Albany on or before January 31, 2023, were stolen out of the mail; and BE IT FURTHER RESOLVED, that the enforcing officer shall remit such interest only to taxpayers who have shown proof satisfactory to the enforcing officer that such taxpayers’ property tax payments were stolen from the mail; and BE IT FINALLY RESOLVED, that the Clerk of the Common Council shall notice a public hearing regarding this resolution. The checks had “City of Albany” removed, with another person or entity written in its place. Some, but not all, payments were stopped, and many taxpayers do not have the extra cash to pay their tax bills. APD and other law enforcement agencies are working diligently on investigating the situation, but affected taxpayers have no recourse in the meantime. Section 1182 of the Real Property Tax Law allows the governing body of a tax district to authorize the enforcing officer of such district to “permit the cancelation in whole or in part of any interest, penalties or other charges imposed by law to which the tax district or any other municipal corporation may be lawfully entitled.” NECESSITY FOR LEGISLATION AND ANY CHANGE TO EXISTING LAW The Council is asked to permit cancelation of interest in this situation out of fairness to the affected taxpayers. In order for the Council and the Treasurer to utilize the authority granted under RPTL § 1182, the Council must authorize such use by resolution.. FISCAL IMPACT None, as the City would not have been entitled to the interest now due, owing, and unpaid on the affected taxpayers’ property had their checks not been stolen out of the mail. Council Members Flynn, Anane, Clarke, Love, and Zamer introduced the following: RESOLUTION 18.31.23R A RESOLUTION OF THE COMMON COUNCIL HONORING DOMINIQUE DANIELS, FRANK SANTOS, AND JACOB HOBBS OF THE DEPARTMENT OF GENERAL SERVICES FOR THEIR BRAVERY AND QUICK ACTION IN SAVING A LIFE WHEREAS, on February 15, 2023, Dominque Daniels, Frank Santos, and Jacob Hobbs of the Department of General Services were on a recycling route on Myrtle Avenue when they noticed a person in distress; and WHEREAS, despite initial indications that the person was simply scratching their back, the crew quickly realized that the situation was much more serious – the person was not wearing shoes, was not moving and appeared to be suspend from a tree; and WHEREAS, with quick thinking and bravery, the crew approached the person and discovered that the individual had attempted to take their own life and was in need of immediate medical attention WHEREAS, the crew’s driver immediately contacted 911 and the crew’s supervisor, while the others worked to bring the person down from the tree and keep them awake, ultimately saving their life by preventing their airway from closing; and WHEREAS, the emergency medical services and police department credited the crew with saving the person’s life by their heroic actions; NOW, THEREFORE, BE IT RESOLVED, that the City of Albany hereby honors Dominque Daniels, Frank Santo, and Jacob Hobbs of the Department of General Services for their bravery and quick action in saving a life on February 15, 2023, and thanks them for their outstanding service to the community; and BE IT FURTHER RESOLVED, that copies of this resolution be presented to Dominique Daniels, Frank Santos, and Jacob Hobbs. NECESSITY FOR LEGISLATION AND CHANGES TO EXISTING LAW In 2020, the Federal Government completed the most recent census, providing more accurate population counts for the various areas within the City of Albany. These new numbers showed that the populations of the Wards were no longer mostly equal. This law replaces the old Wards and their boundaries with newer ones. These new lines were drawn by the City of Albany Redistricting (Reapportionment) Commission, which was mandated to consider the application of the “one person, one vote” concept and the equal protection clauses of the Fourteenth Amendment of the United States Constitution and Article I, Sections I and II of the New York State Constitution. Therefore, they have equal population and protect minority voting rights.
