Subsection (A) of section 359-22 (Parking, standing and stopping restrictions) of Article II (Traffic Regulations) of Chapter 359 (Vehicles and Traffic) of Part II (General Legislation) of the Code of the City of Albany is hereby amended by adding a new paragraph (11) to read as follows: (11) In a space designated as provided in this paragraph for the exclusive purpose of charging an electric vehicle at an electric vehicle charging station, unless such vehicle is an electric vehicle connected such charging station, provided, however, that an electric vehicle disconnected from the electric vehicle charging station for no more than thirty continuous minutes while stopped, standing, or parked in such designated space shall not be in violation of this paragraph. Parking spaces designated for the exclusive purpose of charging an electric vehicle at an electric vehicle charging station shall be clearly identified, and such designation shall include conspicuous and permanently installed signs or markings which identify such space as an electric vehicle charging station, indicate that such space is only for electric vehicle charging, and include any day or time restrictions. For the purposes of this paragraph, the term “electric vehicle” shall mean a motor vehicle that is propelled at least in part by an electric motor and associated power electronics which provide acceleration torque to the drive wheels sometime during normal vehicle operations, and that draws electricity from a battery or hydrogen fuel cell that is capable of being recharged from an external source of electricity, such that the external source of electricity cannot be connected to the vehicle while the vehicle is in motion. For purposes of this paragraph, the term “electric vehicle charging station” shall mean the equipment needed to convey electric power from the electric grid or another power source to an onboard motor vehicle energy storage system. Section 2. Subsection (E) of section 359-87 (Schedule of fines) of Article IX (Penalties for Parking Violations) of Chapter 359 (Vehicles and Traffic) of Part II (General Legislation) of the Code of the City of Albany is hereby amended by adding a new paragraph (19) to read as follows: (19) Parking in a space designated for charging electric vehicles in violation of section 359-22(A)(11) of this Chapter. To: Danielle Gillespie, City Clerk From: Brett Williams, Esq., Sr. Assistant Corporation Counsel Re: Common Council Legislation Supporting Memorandum Date: March 24, 2022 Sponsor: Council Member Balarin ORDINANCE 7.41.22 TITLE AN ORDINANCE AMENDING CHAPTER 359 (VEHICLES AND TRAFFIC) OF THE CODE OF THE CITY OF ALBANY IN RELATION TO THE PARKING OF ELECTRIC VEHICLES GENERAL PURPOSE OF LEGISLATION This ordinance updates parking regulations within City Code to reflect the existence of the roadside electric vehicle charging stations now located in various areas of the City, and to provide that the parking spaces adjacent to such charging stations are reserved for the exclusive use of electric vehicles. NECESSITY FOR LEGISLATION AND CHANGES TO EXISTING LAW Section 1 of the ordinance updates § 359-22 (A) of the Code, which lays out the areas and situations in which “no person shall [s]top, stand or park a vehicle…” The new paragraph (11) provides that only electric vehicles may park in such spaces, either while using the adjacent charging station to charge, or for no more than a half hour if not actively charging. Section 359-87 of the Code, which Section 2 of this ordinance amends, lays out the schedule of fines for parking violations. The new paragraph (E)(19) provides for a fine of $35 for improperly parking in an electric vehicle charging spot. FISCAL IMPACT(S) The Division of Traffic Engineering may incur some expenses related to updating signage in accordance with Section 1 of this ordinance. Fines of $35 will be issued for violations of Section 1 of the ordinance. Council Member Flynn introduced the following: ORDINANCE 8.41.22 AN ORDINANCE AUTHORIZING AND DIRECTING THE GRANT TO NATIONAL GRID OF AN EASEMENT OVER A PORTION OF CITY-OWNED PROPERTY AT 900 NEW SCOTLAND ROAD FOR THE INSTALLATION OF AN UNDERGROUND GAS LINE The City of Albany, in Common Council convened, does hereby ordain and enact: Section 1. It is hereby authorized that the City of Albany grants an easement to National Grid over a portion of City-owned property at 900 New Scotland Road, in the City of Albany, for the purpose of the installation of an underground gas line, and as described more fully in the easement attached hereto. Section 2. The form, content, terms and conditions of such easement shall be approved by the Corporation Counsel. Section 3. National Grid has stated that an easement over a portion of City-owned property located at 900 New Scotland Road is needed for the required repairs and safety upgrades to be made to the existing Gas Regulator Station per the plans and drawings for the project, as shown on the attached Exhibit “A.” All associated project work and construction is at the sole cost and expense of National Grid. The easement request has been reviewed by the Technical Review Committee, and the project has received the requisite approval from the Department of Planning & Development. The form, content, terms and conditions of the easement, once authorized, will be approved by the Corporation Counsel. NECESSITY FOR LEGISLATION AND ANY CHANGE TO EXISTING LAW Common Council approval is required for land transactions, such as the granting of a permanent easement over municipal property. Council Member Romero introduced the following: ORDINANCE 9.41.22 AN ORDINANCE AMENDING ARTICLE II (SKATEBOARDS) OF CHAPTER 255 (PEACE AND GOOD ORDER) OF THE CODE OF THE CITY OF ALBANY IN RELATION TO THE REGULATION OF SKATEBOARDING IN THE CITY OF ALBANY The City of Albany, in Common Council convened, does hereby ordain and enact: Section 1. Article II (Skateboards) of Chapter 255 (Peace and Good Order) of Part II (General Legislation) of the Code of the City of Albany is hereby amended to read as follows § 255-8 Definitions Skateboard defined. For the purposes of this article, the following terms shall have the meanings indicated: SKATEBOARD A single platform which is mounted on wheels, designed or used in fact for riding underfoot, having no mechanism or other device with which to steer or control the direction of movement thereof while being used. § 255-9 Restricted use areas Regulation. Areas in the City of Albany in which skateboard riding is prohibited are as follows: A. All public and private sidewalks, roadways (including the entire paved and improved surface thereof including curbs), parking lots, driveways and courtyards within the boundaries set forth below: (1) All that area bounded by and including Lark Street south of Madison Avenue on the west, Clinton Avenue on the north, Broadway on the east and Myrtle Avenue on the south. B. Also, all basketball courts, tennis courts and handball courts within the City of Albany C. In No person shall use or ride a skateboard in, on, or upon any publicly owned monument, sculpture, or other statuary. § 255-10 Regulations. A. No person shall use or ride on a skateboard in or upon any of the areas and locations listed in § 255-9. B. In all other areas within the City of Albany, skateboard use is permitted so long as it is not effected in a manner that creates a risk of danger to any person or property or impedes or interferes with pedestrian or vehicular traffic. Section 2. This ordinance shall take effect immediately. APPROVED AS TO FORM THIS 24TH DAY OF MARCH, 2022 _____________________________ Corporation Counsel To: Danielle Gillespie, City Clerk From: Gabriella Romero, Council Member, 6th Ward Re: Common Council Legislation Supporting Memorandum Date: March 24, 2022 Sponsor: Council Member Romero ORDINANCE 9.41.22 TITLE AN ORDINANCE AMENDING ARTICLE II (SKATEBOARDS) OF CHAPTER 255 (PEACE AND GOOD ORDER) OF THE CODE OF THE CITY OF ALBANY IN RELATION TO THE REGULATION OF SKATEBOARDING IN THE CITY OF ALBANY GENERAL PURPOSE OF LEGISLATION As Albany begins to move away from vehicular-only modes of transportation, we must identify and uplift all other modes of transit. The proposed changes remove the jurisdictional component of the previous legislation, allowing for skateboards to move freely around our City. It further removes the specifically punitive effects of skateboarding; however, skateboards must still abide by the NYS Vehicle and Traffic Law, which would be enforced by public safety officials. The only remaining restriction, under this ordinance, bans skateboarding on public monuments, sculptures, and statues. To note, there are no restrictions on in-line skaters, bicyclists, or pedestrians. Any unruly behavior by this movants is enforced through existing law by public safety officials. NECESSITY FOR LEGISLATION AND ANY CHANGE TO EXISTING LAW These changes provide parity with bicyclists and pedestrians. Skateboarding is more than a mode of recreation; it is also a means for transportation and should not be criminalized or subject to specifically punitive effects. FISCAL IMPACT None. Council Member Johnson introduced the following: RESOLUTION NUMBER 35.41.22R A RESOLUTION OF THE COMMON COUNCIL HONORING THE LIFE AND LEGACY OF JEWEL AND GRACE LOVE AND RENAMING A PORTION OF FIRST STREET IN THEIR HONOR WHEREAS, Jewel and Grace Love left a legacy and laid a foundation of greatness for their family and the community. They were activists and committed to the betterment of the Fifth Ward and the City at large, as evidenced by their willingness to serve. Jewel Love, throughout his life, received many awards and accolades including the Lights of Love Award which was presented to him in 2013; and WHEREAS, Jewel Love was born in 1914 in Tucker, Arkansas where he worked in the fields to help his parents provide for his younger siblings. It was also in Arkansas where he devoted his life to the Lord and was baptized at First Baptist Church in Tucker; and WHEREAS, Grace Sims was born in 1922 in Little Rock, Arkansas where she met the love of her life, Jewel Love, at the age of 14, and the two were joined in wedlock two years later in 1938. The Loves were determined to build a better life for themselves and their daughters, so they migrated to Albany, New York in 1940; and WHEREAS, when the Love family arrived in racially segregated Albany, they were able to find housing on Broadway and Mr. Love immediately set out to find work to support his family. He was subsequently hired at the Allegheny Ludlum Steel, known today as Al-Tech Specialty Steel Corp, where he worked until he retired in 1979; and WHEREAS, the Loves proved to be a power couple in the City of Albany – one that tirelessly gave of themselves. After migrating here and finding permanent housing at 159 First Street, which they would later purchase, making them one of the few black land owners in the area, they opened their doors to relatives migrating from the South, looking for better opportunities; and WHEREAS, Grace Love proved to be a great woman in her own right and supported her husband as he worked in the steel industry, his work as a founding member of the gospel group known as the Jolly Five, his softball endeavors in the Arbor Hill community and his licensure as an exterminator in the City of Albany; and WHEREAS, Jewel Love completed a program of intense study learning how to mix chemicals while maintaining full time employment and, in 1970, he took and passed the state examination for exterminators, later starting his own exterminating business. He purchased a small building on 142 First Street which was known as Love’s Exterminator, the site where he produced his chemicals. Jewel Love was the first person of color in the City of Albany to become a licensed exterminator; and WHEREAS, both Grace and Jewel Love were committed to growing and serving in God’s kingdom. Grace was appointed to the Deaconate Ministry by Reverend Dr. Earnest E. Drake and was a devout member of the Metropolitan New Testament Mission Baptist Church. Deaconess Grace also served on the Progressive “500” Ministry and the Eula Holmes Auxiliary; NOW, THEREFORE, BE IT RESOLVED, that the Albany Common Council honors the life and legacy of Jewel and Grace Love and directs that an honorary street sign to read “Jewel and Grace Love Way” shall be placed adjacent to the existing sign at First and Lark Street to Swan First Street.
