Building materials. There will be no collection of waste building materials, large amounts of concrete, felled trees and the like, with the following exceptions. The term “infestation” shall mean any material infested with bedbugs, rodents or other insects considered a threat to public health and safety. 2. All mattresses, boxsprings, and bedding must be bagged in heavy-duty plastic bags or hypoallergenic mattress cover at least 0.8 mm thick, regardless of whether they are infested or not. All plastic bags and coverings should be taped with duct or box tape so there are no openings. 3. No person shall place, discard or dispose of any bedding, furniture, mattresses, clothing or other material with infestation on the public way, or in a refuse container or dumpster located on the public way, for curbside pickup, except when totally enclosed in a heavy-duty plastic bag or hypoallergenic mattress cover at least 0.8 mm thick and labeled as being infested. All plastic bags and coverings should be taped with duct or box tape so there are no openings. 4. No furnishing, bedding, clothing or other infested material shall be recycled. 5. The Commissioner of General Services shall ensure that personnel engaged in curbside collection under this article are trained in handling infested materials and that the proper equipment is available therefor and shall further ensure that City vehicles are pest free. Subsection (A) of section 313-7 (Penalties for offenses) of Article I (Removal of Garbage) of chapter 313 (Solid Waste) of Part II (General Legislation) of the Code of the City of Albany is hereby amended to read as follows: A. Any person, firm, partnership, corporation or other entity who or which shall knowingly and willingly violate or assist in the violation of the provisions of this article, or who or Matter in strikethrough to be deleted. Subsection (A) of section 261-2 (Examining Board of Plumbers) of Chapter 261 (Plumbing) of Part II (General Legislation) of the Code of the City of Albany is hereby amended to read as follows: A. There is hereby created a Board to be known as the “Examining Board of Plumbers,” which shall consist of five members, all residents of the City of Albany, to be appointed by the Mayor of the City of Albany, of whom two and only two shall be an employing or master plumbers of not less than 10 ten years' experience each in the business of plumbing, and one and only one of whom shall be a journeyman plumber. The remaining members shall be the Chief Inspector of Plumbing for the City of Albany and the engineer having charge of sewers in and for the City of Albany of like experience, and the other members of such board shall be the chief inspector of plumbing and drainage of the City of Albany, or offier performing the duties of such inspector, and the chief engineering having charge of the sewers in the City, but in the event of there being no such officers in the City, then any two other officers having charge or supervision of the plumbing, drainage, or sewers, whom the Mayor shall designate or appoint. The term of office for each member of such Board shall be three years from the first day of January following his appointment. Vacancies occurring by expiration of term shall be filled by the Mayor for a full term. Vacancies by death, removal, inability to act, resignation or removal from the City of any member shall be filled by him for the unexpired term. The Chief Inspector of Plumbing and Drainage and the engineer in charge of sewers shall be ex officio members of such Board, and when they shall cease to hold their offices by reason or on account of which they were so designated for appointment, their successors shall act on the Examining Board in their stead. Any member or members may be removed by the Mayor for malfeasance in office, incapacity or neglect in duty. Such Board shall elect its own Chairman and Secretary. A majority shall constitute a quorum to transact the business thereof. The Board shall meet at stated intervals and shall have authority to hold special meetings if, in the opinion of the Chairman or a majority, such are desirable for the proper and efficient discharge of the business of such Board. It shall adopt such rules and regulations for the examination of all persons who desire to obtain a license as hereinafter required. (ii) Where any such structure is damaged or destroyed to the extent of 50% or less of the cost of replacement of the structure new, repair or restoration of such structure may be made; to enable continued operation of the nonconforming use, provided that no repairs or restorations shall be made which would create or increase any parking, yard or space and bulk nonconformity, nor shall any repairs or restoration (except in conformity with the applicable zoning district regulations) be made unless a building permit is obtained and restoration is actually begun within one year after the date of such partial damage or destruction and is diligently pursued to completion. (f) Repair and maintenance. Normal maintenance and repairs, including but not limited to replacement, and installation or relocation of walls, partitions, fixtures, wiring or plumbing, may be performed on mechanical systems or existing portions of any structure devoted in whole or in part to a nonconforming use. (g) Enlargement of structure. No structure devoted in whole or in part to a nonconforming use shall be altered, enlarged or added to in any manner which would enlarge the nonconforming portion or create a new nonconformity. (h) Multi-unit dwelling exception. This change, aimed at reducing future brownfield impacts and aligning with the shift toward renewable fuels, was based on the finding that all neighborhoods had reasonable access to existing stations. As a result, existing vehicle fueling stations became nonconforming uses. Chapter 375 defines a nonconforming use as “a use of a lot or a structure that was legally established prior to the effective date of [Chapter 375], but that does not conform to the current zoning regulations of the district in which it is located.” Under §375-506, nonconforming uses may continue and be transferred but may not expand, except for reasonable repair, maintenance, or reestablishment after discontinuance. Subsection (g) specifically prohibits any enlargement or alteration that would expand the nonconforming use or create new nonconformities. Rather than reintroducing vehicle fueling stations as a permitted use in the MU-CH or other affected zoning districts, an approach inconsistent with the original legislative intent, this ordinance proposes a targeted amendment to the nonconforming use provisions. While previous legislation sought to retain existing fueling stations, it did not explicitly address whether alterations or expansions should be permitted. In certain cases, such changes may be necessary to ensure continued operation. Moreover, many older vehicle fueling stations were designed under outdated standards and are now incompatible with modern design requirements and the safe, orderly flow of vehicular and pedestrian traffic. This is typical and not considered adverse. • Land: Neighborhood - Description The immediate neighborhood consists of single family dwellings with some commercial and multi family dwellings interspersed.The commercial property in this area consists mostly of retail and offices serving the local residents and have no adverse impact on marketability.Community Services are considered typical for the area. Overall neighborhood appeal is considered average. Access to retail,support services, recreational areas, and employment opportunities is close by. • Land: Site - Highest and Best Use Subject property is currently used vacant land. “Highest and best use” is defined as the reasonably probable and legal use of vacant land or an improved property, which is physically possible, appropriately supported, financially feasible and that results in the highest value. Our conclusion is that the subject’s highest and best use is its current use as a vacant land. • Land: UTLOSI_TYP_TXT The site is typical for the area in terms of size and appeal. No adverse easements, encroachments or special assessments noted or disclosed. The subject is to have private well and septic to be installed on site. The hookups are typical of the area, market accepted. Determination of the potability of the subject's water supply is beyond the scope of this appraisal. The subject was inspected form the street only and its unknown if any well or septic exists on the subject property. Public water is not available in the subjects market area and a hook up to a public water source would exceed 3% of the OOV of the subject and is not feasible. Public sewer is not available in the subjects market area and a hook up to public sewer would exceed 3% of the OOV of the subject and is not feasible. • Land: Site - Adverse Conditions or External Factors On the date of inspection the appraiser did not observe any apparent adverse environmental conditions in the improvements, on the subject's site or in the immediate vicinity of the subject property. The presence of hazardous environmental substances such as radon gas, lead paint, uffi insulation etc. cannot be determined during an appraisal inspection. Further, the appraiser is not qualified to analyze or uncover hazardous substances and assumes no responsibility for such conditions or the engineering, which might be required to discover the same. The final opinion of value is based on the assumption that the subject property is not negatively affected by the existence of hazardous substances or detrimental environmental conditions. The appraisal is based on the assumption that the subject property conforms to state environmental guidelines. If the property does not conform, the estimated opinion of value can change by an unspecified amount. Upon transfer of a property, it is the lender's responsibility to certify compliance. The appraiser inspected the subject and surrounding neighborhood on the reported effective date of this appraisal report and it appears that the subject has no damage from the recent Hurricane Sandy. I herby certify that, to the best of my knowledge and belief, the inspection revealed no indications to significant or moderate physical damage to the property or neighborhood due to the recent storm. The subjects neighborhood and surrounding immediate area has sustained no visible damage from the recent storms or any act of nature. To clarify the differences between exposure and marketing times: • Exposure time is deemed to expire as of the effective date the appraisal - it examines the time frame leading up to the date of valuation, linking the value estimate to how long the property would have required exposure in order to sell at the estimated market value. • Marketing time is deemed to start at the effective date of the appraisal, looking forward in time. It is a prediction of how long a property would require exposure to a competitive and open market in order to find a buyer, under either typical or prescribed circumstances.
