The purpose and scope of this part is to provide tenants of the City of Albany at large with the tools and resources to be knowledgeable and informed residents. This Part provides transparency, and empowers tenants to protect their housing rights and help make the right choice when choosing a property to rent. Finally, this Part will help landlords by incentivizing remediation of potential code violations. § 231-138 Database information. A. The Department of Building and Regulatory Compliance (hereinafter “the Department”) shall maintain, through the Department’s website, a publicly-accessible electronic interface that reports code violation, building permit applications, and complaint information based on the name of the property owner and the address of the property. This interface shall include: (1) The mailing address of each registered property owned by such registered owner; (2) The name of the corporate entity associated with the property owner, if applicable; (3) The nature of all code violations that have occurred at the property, including the date issues, opened, resolved, and for each action taken on each violation: (a) The inspector that observed or acted on the violation; (b) The date and time such action was taken; and (c) The proposed next step to remediate the alleged violation; (4) The number of violation complaints involving the property; Matter in strikethrough to be deleted. NECESSITY OF LEGISLATION AND CHANGES TO EXISTING LAW With this database, tenants and prospective homeowners will have the tools and resources to see and understand potential unsafe and unfit conditions. The bill continues a trend of transparency for the residents of the City of Albany, and empowers tenants to protect their housing rights. This will also protect property owners and landlords, to provide a real-time update on the progress of their remedial updates. The Department of Building and Compliance is updating their internal software and will be able to provide a public interface to the City of Albany. Chris Martell, the owner of 1053 Brewing, LLC, which owns 1053 Broadway and operates Druthers Brewing Company, located at 1053 Broadway, seeks an easement to install, construct, and maintain an ADA-Compliant ramp and deck for additional seating at Druthers. Mr. Martell submitted applications for three area variances associated with this project to the Board of Zoning Appeals (the “Board”), and the Board conditionally approved each on March 16, 2022. During the Board’s review of the three area variances, the Board served as lead agency for the coordinated review of the project (an Unlisted Action) under SEQRA and identified the Common Council as an involved agency. The Common Council consented to the Board’s lead agency designation on December 30, 2021. On February 2, 2022, the Board adopted a Determination of Non-Significance Resolution and issued and adopted a Negative Declaration for the project, thus fully complying with and concluding the SEQRA process. As an aside, please note that before requesting area variances and this easement, Mr. Martell explored other options, such as purchasing 1043 Broadway and building a rooftop deck to accommodate additional outdoor seating. For various reasons, these options were not available to Mr. Martell. A site plan map of the proposed ramp and deck, and an appraisal report for the subject property, are included herewith as Attachments “A” and “B,” respectively. NECESSITY FOR LEGISLATION AND ANY CHANGE TO EXISTING LAW Common Council approval is required for land transactions, such as the granting of a permanent easement in the City’s right-of-way. SPECIFICS OF REAL PROPERTY SALE OR ACQUISITION (if applicable) The subject portion of the Bridge Street Right-of-Way in the area of 1053 Broadway has a valuation of approximately $3,500. In this instance, the City of Albany seeks to grant a utility easement to National Grid over a portion of City-owned property located at 6 MLK Blvd, commonly referred to as the Beaver Creek Satellite Facility (hereinafter the “Facility”), in Lincoln Park, in the City of Albany, for the purpose of installing a transformer and electrical line to power the Beaver Creek Satellite Facility. National Grid’s transformer and electrical line, requiring the easement herein described, are necessary to power the Facility. The transformer will be installed adjacent to the Facility and the electrical line will travel from the entrance of the Facility, around the Facility, to the Southwest corner of the Facility. The easement request has been reviewed by the Technical Review Committee. The Department of General Services noted that National Grid will be required to apply for and receive approval of a street-opening permit for the installation work. Subsection A of Section 359-7 (Motorized scooters) of Article I (Bicycles and All Motor Vehicles) of Part II of the Code of the City of Albany is hereby amended to read as follows: A. Definition of “motorized scooter.” For purposes of this section, the term “motorized scooter” shall mean any wheeled device that has handlebars that is designed to be stood or sat upon by the operator, is powered by an electric motor or by a gasoline motor that is capable of propelling the device without human power, is less than 24 inches in height and is not capable of being registered with the New York State Department of Motor Vehicles. For the purposes of this section, the term “motorized scooter” shall not include wheelchairs or other mobility aids designed for use by disabled persons, electric- or gas-powered devices not capable of exceeding 15 miles per hour or “electric personal assistive mobility devices” defined as self-balancing, two-non-tandem-wheeled devices designed to transport one person by means of an electric propulsion system. NECESSITY FOR LEGISLATION AND CHANGES TO EXISTING LAW In 2005, Albany enacted Ordinance No. 39.122.04, defining the term “motorized scooter” and restricting their use on public streets and roadways. One factor defining these “motorized scooters” was having handlebars. Since then, the increased popularity of devices such as electric unicycles has created a loophole where laws applying to most motorized devices do not apply if they do not have handlebars.
