The closest lot line for the proposed parking lot is no more than 300 feet from a lot line of the property or properties to be served; 3. NECESSITY FOR LEGISLATION AND ANY CHANGE TO EXISITING LAW As a counter to the atmosphere of exclusion and erasure that’s happening on the national level it’s important to reaffirm that Albany is a welcoming community. This addition to the city charter is an important statement of principles and values appropriately placed in the charter as our primary governing document. By placing it in the charter it would be permanently enshrined in our city code as opposed to resolutions that Council from time to time adopts. This Charter amendment does not require a referendum pursuant to section 23 of the Municipal Home Rule Law. FISCAL IMPACT The issuance of an additional $200,000 in debt will result in increased debt service costs of approximately $20,000 annually in future fiscal years. The hookups are typical of the area, market accepted. Determination of the potability of the subject's water supply is beyond the scope of this appraisal. The subject was inspected form the street only and its unknown if any well or septic exists on the subject property. Public water is not available in the subjects market area and a hook up to a public water source would exceed 3% of the OOV of the subject and is not feasible. Public sewer is not available in the subjects market area and a hook up to public sewer would exceed 3% of the OOV of the subject and is not feasible. • Land: Site - Adverse Conditions or External Factors On the date of inspection the appraiser did not observe any apparent adverse environmental conditions in the improvements, on the subject's site or in the immediate vicinity of the subject property. The presence of hazardous environmental substances such as radon gas, lead paint, uffi insulation etc. cannot be determined during an appraisal inspection. Further, the appraiser is not qualified to analyze or uncover hazardous substances and assumes no responsibility for such conditions or the engineering, which might be required to discover the same. The final opinion of value is based on the assumption that the subject property is not negatively affected by the existence of hazardous substances or detrimental environmental conditions. The appraisal is based on the assumption that the subject property conforms to state environmental guidelines. The appraiser inspected the subject and surrounding neighborhood on the reported effective date of this appraisal report and it appears that the subject has no damage from the recent Hurricane Sandy. To clarify the differences between exposure and marketing times: • Exposure time is deemed to expire as of the effective date the appraisal - it examines the time frame leading up to the date of valuation, linking the value estimate to how long the property would have required exposure in order to sell at the estimated market value. • Marketing time is deemed to start at the effective date of the appraisal, looking forward in time.
