(ii) The property owner shall occupy either the primary or the accessory dwelling unit as their primary residence. (iii) On lots containing an accessory dwelling unit, neither the primary nor accessory dwelling unit may be made available for rent by guests for less than thirty consecutive days where the unit is offered for tourist or transient use. (ix) An attached accessory dwelling unit shall be subject to the same setback, height and impervious lot coverage regulations as the primary structure. (x) A detached accessory dwelling unit shall be subject to the same setback regulations as accessory structures. (xi) An accessory dwelling unit, whether detached or attached to a primary dwelling structure, may be directly accessed from an alley, but shall not be accessed via a driveway separate from that serving the primary dwelling structure. (xii) When an accessory dwelling unit is attached to a principal dwelling structure, only one entrance structure may face the front lot line. (xiii) An existing accessory structure whose height, setbacks, or impervious lot coverage do not meet the requirements of a dwelling in its zoning district, may be converted into an accessory dwelling unit, but the structure may not be altered in any way that increases the noncompliance. The first step in this process is to determine whether the contemplated action is a Type I, Type II, or unlisted action under SEQRA. If an action meets any of the criteria listed in the regulations for action Types I and II, it is one of those types of actions. Here, because the project does not meet any such criteria, it is an unlisted action. The next step for an unlisted action is to complete an Environmental Assessment Form (the full version of which – the “FEAF” – has been completed by the Director of Infrastructure Management for this project). A copy of Parts I, II, and III of the FEAF for this project matter is included herewith. Unlisted actions do not require coordinated review with other involved or interested agencies, so once the FEAF is completed, the entity undertaking the review can review the potential environmental impacts of the project and make a determination as to whether the project will have any negative environmental impacts. This resolution accomplishes these steps in the SEQRA process. The first step in this process is to determine whether the contemplated action is a Type I, Type II, or unlisted action under SEQRA. If an action meets any of the criteria listed in the regulations for action Types I and II, it is one of those types of actions. Here, because the project does not meet any such criteria, it is an unlisted action. The next step for an unlisted action is to complete an Environmental Assessment Form (the full version of which – the “FEAF” – has been completed by the Director of Infrastructure Management for this project). A copy of Parts I, II, and III of the FEAF for this project matter is included herewith. Unlisted actions do not require coordinated review with other involved or interested agencies, so once the FEAF is completed, the entity undertaking the review can review the potential environmental impacts of the project and make a determination as to whether the project will have any negative environmental impacts. This resolution accomplishes these steps in the SEQRA process. NECESSITY FOR LEGISLATION AND ANY CHANGE TO EXISTING LAW This resolution formally expresses the Council’s determinations that 1) the Action is unlisted, 2) the Council is the appropriate entity to conduct the SEQRA review of this Action, and 3) that, having reviewed the FEAF prepared for this Action, the Action will have no negative environmental impacts. Ironically, the bulk of 520 Livingston, with the exception of a prefabricated warehouse addition, was constructed in the mid 20th century as a Boys Club community center. The parquet gym floor, from the Boys club, is still present. The City is seeking to fill a significant gap in services for the West Hill Community. The building was used as a commercial operation from the early 1980s until the City purchased it 2023. It was not used primarily for warehouse and office operations. the 23,000 square foot building will be significantly rehabilitated. Hazardous materials such as lead paint, asbestos tile and roof materials will be abated and removed. The prefabricated addtion and concrete slab it's on will be dismantled and removed as the addition is not on grade with the rest of the site (presenting a significant access challenge) and it it's size is not suited for repurposing to a gymnasium. The reconstruction will allow for energy efficiency upgrades, storm water improvements and aesthetic improvements. The project will meet all current code and ADA requirements, as well as storm-water requirements for the CSO. A new outdoor pool and leasable health clinic space will also be part of the project. The future Albany West Recreation Center was originally constructed in the mid-20th century as community center before being converted to a commercial operation decades late in the 1980s. The City’s historic investment in the redevelopment of the property represents a ‘coming home’ and fulfilling a significant community need in West Hill. The intent of the project is to provide a Recreation Center to support public health, assist families, and employ local talent to increase the quality of life of Albany residents. This project seeks to address the need for a public community center and office space that is accessible to all residents, as well as expands the programming offerings and parking access for users. Substantial environmental review was conducted the Phase soil sample reports are enclosed. Some remediation and removal of hazardous material, typical of buildings constructed in this era, is needed prior to renovation. These materials include lead paint, asbestos floor tiles and asbestos roofing materials to name examples. The western warehouse addition will be demolished and replaced as it is not suitable for modern recreation needs - such as a basketball court. Significant improvements in the HVAC and building envelope will mean substantial energy savings. The building will also meet all modern code and ADA requirements. A new parking area will be constructed to meet facility demand. Roof leaders for the building will be disconnected and directed to on-site stormwater management - meaning a net reduction in stormwater volume, and shaved peak flow times, to the city's combined sewer system. There is no substantial increase in building footprint and the renovation allows for expansion of space by allowing utilization of the second floor of the existing building, previously unusable because of access and code issues. A new pool, located in the rear of the property, and a leasable clinical space in the front of the property round out the improvements. The Hoffman Recreation Center was originally constructed in the mid-20th century as a small apartment complex, and was since converted to a recreation center. The facility consists of a two-story building along Hoffman Road, and a rear gymnasium/activity space, previously a vehicle storage/maintenance garage. Minor space and systems renovations have been made to the interiors over the years to improve climate control and lighting, but there continue to be some problems that undermine the use of the space. The current building on Hoffman Avenue has outgrown its programming capacity to meet the community needs, and much of the 2-story building is inoperable to the public, because of potential environmental hazards in the flooring and walls of the building. As this facility also houses the Recreation administrative staff, the plan aims to maintain typical office room spaces, but utilize the compacted space in a more efficient way. The intent of the project is to improve the Hoffman Recreation Center to support public health, assist families, and employ local talent to increase the quality of life of Albany residents. This project seeks to address the need for a public community center and office space that is accessible to all residents, as well as expands the programming offerings and parking access for users. The current administrative offices, which includes a recreation facility, does not meet current standards, or needs of the City of Albany. Substantial environmental review was conducted to meet terms to the HUD grant that the City obtained. The Phase I and Phase II reports are enclosed. The Phase 1 and Phase II assessments yielded no concerning contaminants in the site. Some remediation and removal of hazardous material, typical of buildings constructed in this era, is needed prior to renovation. These materials include lead paint, asbestos floor tiles and aspestos roofing materials to name examples. The rear warehouse addition will be demolished and replaced as it is not suitable for modern recreation needs - such as a basketball court. Significant improvements in the HVAC and building envelope will mean substantial energy savings. The building will also meet all modern code and ADA requirements. A new parking area will be constructed on Hoffman to relieve on street parking pressure. Roof leaders for the building will be disconnected and directed to onsite stormwarer management - meaning a net reduction in stormwater volume, and shaved peak flow times, to the city's combined sewer system. No substantial increase in building footprint and the renovation allows for expansion of space by allowing utilization of the second floor of the existing building, previously unusable because of acces and code issues.
