These new lines were drawn by the City of Albany Redistricting (Reapportionment) Commission, which was mandated to consider the application of the “one person, one vote” concept and the equal protection clauses of the Fourteenth Amendment of the United States Constitution and Article I, Sections I and II of the New York State Constitution. NECESSITY FOR LEGISLATION AND CHANGES TO EXISTING LAW The Albany Police Department is understaffed and overextended. They have multiple responsibilities, tasked with protecting the citizens of Albany, and sometimes, providing these reports are overlooked. However, it is still critical for Council Members to receive this information in order to learn about threats to their communities and how to best legislatively address them. By changing the requirements for this report from quarterly to biannually, the Albany Police Department will be better able to reliably provide this information to Council Members. This will in turn allow the Common Council to create better-informed legislation to keep Albany’s streets safe from firearms. This ordinance also cleans up several typographical errors present in the current law. FISCAL IMPACT(S) None. To: Danielle Gillespie, City Clerk From: Brett Williams, Esq., Senior Assistant Corporation Counsel Re: Common Council Legislation Supporting Memorandum Date: November 23, 2022 Sponsor: Council Member Frederick RESOLUTION 112.121.22R TITLE A RESOLUTION OF THE COMMON COUNCIL ELECTING TO PROVIDE PENSION BENEFIT OF SECTION 41(j) OF THE RETIREMENT AND SOCIAL SECURITY LAW GENERAL PURPOSE OF LEGISLATION Retirement and Social Security Law § 41 (j) allows participating employers to elect to provide additional service credit toward retirement for their employees who are entitled to accumulate sick leave. This legislation opts the City into doing so. The additional credit is available only for those members who are in a retirement plan and who accumulate sick leave. Under this option, members who meets the requirements “shall be granted one day of additional service credit for each day of accumulated unused sick leave which he or she has at time of retirement for service.” For members of Tiers 1 through 5, the maximum additional service credit is 165 days. For Tier 6 members, it is 100 days. This benefit will incentivize employees, particularly those at collectively-bargained sick time payout caps, to utilize sick time more judiciously, thereby reducing overtime expenses for the City. NECESSITY FOR LEGISLATION AND ANY CHANGE TO EXISTING LAW In order to provide its employees with this benefit, the Common Council must pass a resolution to be filed with the New York State and Local Retirement System attesting to the election of this benefit for its employees who are members of the NYSLRS. The above resolution is a form resolution with language promulgated by the NYSLRS. FISCAL IMPACT The additional cost to the City will be approximately $35,000 per year, beginning in 2023.
