APPROVED AS TO FORM 17th Day of December, 2021 _______________________ Corporation Counsel To: Danielle Gillespie, City Clerk From: Council Member Richard Conti, 6th Ward RE: Supporting Memorandum Date: November 16, 2020 Ordinance Number 43.112.20 (MC) Sponsor(s): Council Member Conti Title: AN ORDINANCE AMENDNING ARTICLE XLVI (GENERAL PROVISIONS) OF PART 35 (BOARD OF ZONING APPEALS) OF CHAPTER 42 (DEPARTMENTS AND COMMISSIONS) OF THE CODE OF THE CITY OF ALBANY IN RELATION TO CONFORMING THE SIZE OF THE SIZE OF THE BOARD OF ZONING APPEALS WITH THE NYS GENERAL CITY LAW Purpose: To reduce the size of the Board of Zoning Appeals so as to be in conformance with the NYS General City Law. Summary: Sections 1 through 3 amend various provisions of the City Code related to the establishment of the Board of Zoning appeals to: reduce the membership of the Board from 7 to 5 members; set terms of appointment at five years; and establish a Board quorum of 3 members. Section 4 establishes a procedure for the appointment of the newly constituted Board so that terms are staggered with one seat coming up for appointment each year. Current members of the Board would continue with the reduction in membership coming from three vacancies that currently exist. Section 5 ratifies and continue those provisions of the code not being amended. Section 6 provides for an immediate effective date. Justification: Municipal boards of zoning appeal are established under section 81 of the NYS General City Law. That section sets forth the standards and authority of BZAs as well as composition and terms of office. Current provisions of the GCL provide that BZAs be composed of 3 to 5 members. The GCL also provides that: Any board of appeals which, upon the effective date of this section has seven members, may continue to act as a duly constituted zoning board of appeals until the legislative body, by local law or ordinance, reduces such membership to three or five. However, no incumbent shall be removed from office except upon the expiration of his or her term. While the GCL did not terminate BZAs of seven members (as is the current case for Albany’s BZA), it contemplated a process by which these boards would come into compliance with the GCL and specifically through vacancies in membership. The current Albany BZA has one vacant position and two positions expiring on December 31, 2021 putting us in an ideal position to reduce the size of the BZA to 5 members in conformance with the GCL without the need to terminate current members. In addition, with adoption of the USDO, a substantial portion of the workload previously assigned the seven member BZA has been transferred to the five member Planning Board reducing the need for a large BZA that’s not in conformance with the GCL. Fiscal Impact: Minimal savings. The city budget provides stipends for members of the BZA, a reduction of 2 members would provide an annual savings of approximately $4,000 annually. To: Danielle Gillespie, City Clerk From: John-Raphael Pichardo, Esq., Research Counsel Re: Common Council Legislation Supporting Memorandum Date: March 5, 2021 SPONSOR Council Member Anane LOCAL LAW D OF 2021 TITLE A LOCAL LAW AMENDING THE CHARTER OF THE CITY OF ALBANY TO PROVIDE FOR ADDITIONAL PAID SICK LEAVE GENERAL PURPOSE OF LEGISLATION Because paid sick leave is one of the most effective tools to protect public health and stop the spread of illnesses, the New York State legislature passed legislation providing for paid sick benefits, paid family leave, and benefits due to disability for employees subject to a mandatory or precautionary order of quarantine or isolation due to COVID-19. The state legislature and the Governor found that “[p]aid sick leave alleviates the financial pressure for the people that feel they must go to work to keep their job, curbing the spread of their illness to coworkers and commuters”. Further, “in light of the unprecedented nature of the COVID-19 outbreak and its impact on New York Workers” the state directed that municipal employees subject to a mandatory or precautionary order of quarantine or isolation must be provided with the one, 14-day paid sick leave event. Certain City employees, including those who routinely come into contact with the public and cannot do their work from home if subject to a mandatory quarantine or isolation order, may find themselves subject to more than one mandatory quarantine or isolation period during this extended pandemic period. Further, given global climate change and increasing loss of habitat, it is likely that human contact with other uncontrollable and/or highly communicable diseases or viruses in the future may result in subsequent epidemics or pandemics making it necessary to quarantine employees in the future, to enable the continuation of City government and to protect public health. NECESSITY FOR LEGISLATION AND CHANGES TO EXISTING LAW The intent is to authorize the Mayor to provide additional periods of paid sick leave during a public health crisis or emergency where necessary to ensure the safe and continued operation of City government and to protect residents from communicable diseases, as allowed by New York State General Municipal Law § 92. FISCAL IMPACT(S) To be determined Council Member Anane introduced the following: Ordinance Number 34.101.18 As Amended AN ORDINANCE AMENDING CHAPTER 359 (VEHICLES AND TRAFFIC OF THE CODE OF THE CITY OF ALBANY” IN RELATION TO SPECIAL EVENT PARKING The City of Albany, in Common Council convened, does hereby ordain and enact: Section 1. Subsection A of Chapter 359-89 of the Code of the City of Albany is amended to read as follows: A. The Chief of the Department of Police is hereby authorized and directed to designate and establish, as from time to time as [he] they may deem necessary, the manner in which parking within the City of Albany shall be controlled and regulated. Section 2. Chapter 359-89 of the Code of the City of Albany is amended by adding a new Subsection D, to read: D. Special Event Parking: The Chief of the Department of Police shall establish regulations related to Special Event Parking to provide: 1.) The Department of Police shall review all requests for Special Event Parking and approve or deny said requests based on the need to reserve space on City streets for a legitimate purpose. 2.) Upon approval, the Department of Police shall complete the posting of signs and the bagging of meters for the designated area no later than forty-eight hours before the event is to begin. 3.) The signs and bagged meters shall clearly state the dates and times of Special Event Parking and such signs and bags shall be distributed in a manner that makes clear to citizens what areas are designated as restricted parking. 4.) Special Event Parking order request forms shall be made available on the City’s webpage and at City Hall. 5.) The requesting party will be charged a fee according to the following schedule: a. Up to three (3) spaces: $25 b. Four (4) to nine (9) spaces: $50 c. More than ten (10) spaces: $100 6.) The original charge shall allow the space to be reserved for three days. Any posting that goes beyond three days will incur a cost of $15 dollars per additional day. 7.) The following organizations shall be exempt from the fee schedule: a. All government agencies, departments, offices and authorities acting in their official capacity. b. All public, private or charter elementary or secondary schools within the City of Albany. c. All universities or colleges within the city of Albany. Section 3. Chapter 359-89 of the Code of the City of Albany is amended by adding a new Subsection E, to read: E. Emergency No Parking: The Chief of the Department of Police is hereby authorized and directed to establish Emergency No Parking orders. In general, Emergency No Parking orders shall be used in the event of threats to public safety and order, including but not limited to, natural disasters, severe weather, public disaster services, police activity, utility work and unplanned mass gatherings. Section 2. This ordinance shall take effect immediately. Approved as to form this 21st day of November, 2018 _______________________________________ Corporation Council To: Gerald Campbell, City Clerk From: Councilman Owusu Anane Re: Request for Common Council Legislation Date: November 21, 2018 ORDINANCE NUMBER: 34.101.18 TITLE: AN ORDINANCE AMENDING CHAPTER 359 (VEHICLES AND TRAFFIC) OF THE CODE OF THE CITY OF ALBANY IN RELATION TO SPECIAL EVENT PARKING GENERAL PURPOSE OF LEGISLATION: To clarify the City of Albany’s Emergency No Parking law by creating a Special Event Parking designation and adding guidelines for the installation of signage around the City. NECESSITY FOR LEGISLATION: The City of Albany uses a system of Emergency No Parking orders to clear streets during special events including funerals, residential moving days, and concerts. The orders are put up on street signs or with the use of bagged parking meters. Under current City law “The Chief of the Department of Police is hereby authorized and directed to designate and establish, as from time to time as he may deem necessary, the manner in which parking within the City of Albany shall be controlled and regulated.” Traffic Engineering Services is a civilian section of the Police Department and responsible for managing the Emergency No Parking orders for special events under the direction of the Chief. The current law provides no timeframe for notifying residents of an Emergency No Parking order. While signs typically appear to be put up several days in advance, there is no statute requiring that consideration. Corporation Counsel has further added that “internal policies” are aimed at installing signage within 24 hours of Emergency No Parking orders coming to effect. However, without clear legal guidance this internal policy has been ignored on a regular basis. This leads to relatively common scenarios where residents find their cars ticketed or towed because an Emergency No Parking order went up either right before the event in question or with too little warning to reasonably expect residents to react. Residents of the City of Albany should not live in fear of having their cars towed without warning. According to the United States Census Bureau, more than a quarter of the City’s residents live below the poverty line. With this simple legislative adjustment we can save countless residents from the burden of paying unfair parking tickets and towing fees. This legislation would differentiate between Special Events and true emergencies, establish a timeline for signage to be posted, and create revenue with a $45 fee on businesses seeking to take advantage of the Special Event Parking program. Finally, this legislation would update the use of the gender-specific pronoun “he” in reference to the position of the Chief of Police, supplementing the language with “they”.
