The regularly scheduled meeting of the Village of Colonie Planning Commission was held on Tuesday, March 17, 2020. ROLL CALL: Chairman Chris Dennis Commissioners: John Martin Ann Krause (Absent) Peter Chudzinski Kenny Hart Dan Judge (Absent) Jim Splonskowski Mark Keegan, Village Attorney: Victor Caponera Village Engineer: R.J. Laberge (Absent) Code Enforcement: Mike Cerone (Absent) Chairman Dennis opened the meeting at 6:30 p.m. Commissioner Hart led the Pledge of Allegiance and asked that all electronic devices be silenced. The Commission reviewed the minutes from the March 3, 2020 meeting. Commissioner Martin made a motion to approve the minutes as amended. Commissioner Hart seconded the motion. VOTE: Unanimous to approve March 3, 2020 minutes as amended. APPLICANT: 1510 CENTRAL AVE ART THREADING SALON LLC (CHANGE OF OCCUPANCY) Mr. Singh was present before the Commission on behalf of his wife Anamika Singh, owner of Art Threading Salon LLC. Mr. Singh stated that their business offers waxing, threading and facial services as well as henna. The store hours will be 9am to 9pm Monday thru Saturday and 10 am – 4 pm on Sunday. Mr. Singh stated that the landlord or his agent were unable to attend this meeting. Chairman Dennis asked how many employees would be working at a time. Mr. Singh stated that it will just be his wife for now but there are 4 chairs in the salon for potential employees. Commissioner Martin stated that the applicant has identified 16 parking spaces needed on their application which satisfies the parking requirement. 1 VILLAGE OF COLONIE PLANNING COMMISSION MARCH 17, 2020 Commissioner Hart stated that the provided application states that there will be 1-4 employees working at a time. Mr. Singh clarified that it would just be his wife for now, but they hope to hire three more people if business picks up. Commissioner Hart asked if they are planning on expanding the business. Mr. Singh stated that there are no intentions on expanding. Commissioner Martin noted a discrepancy in the hours of operation in the narrative and change of occupancy application. Mr. Singh clarified that the hours of operation would be as previously stated 9 am – 9 pm Monday – Saturday and 10am – 4 pm on Sunday. Commissioner Martin made a motion to approve Art Threading Salon LLC at 1510 Central Ave Suite C. Commissioner Hart seconded the motion. VOTE: Unanimous to approve this application as presented. APPLICATION: 1614 CENTRAL AVE 9 SPICES LLC CHANGE OF OCCUPANCY) Mr. Naresh Upperpalli, owner of 9 Spices LLC and property owner Ramanlal Patel, came before the Commission to present a change of occupancy at 1614 Central Ave. Mr. Upperpalli stated that previous tenant Aroma’s Restaurant closed their business and he is proposing to open his Indian cuisine and bar in the same location. Mr. Upperpalli stated that his restaurant specializes in authentic, ethnic Indian cuisines and he has specialized staff to make his location a unique experience. Chairman Dennis asked if this was a new business. Mr. Upperpalli stated that this is a new restaurant in this area, but he currently operates a similar restaurant in North Carolina. He hopes to open a restaurant in every state. Commissioner Martin asked if the provided floor plan was the existing set up or proposed. Mr. Upperpalli explained that this is the current floor plan and he does not wish to change it at this time. Commissioner Martin explained that the floor and seating plan is important for parking counts and if any changes are made, he must return to the Commission for approval. Mr. Upperpalli agreed. Mr. Upperpalli stated that he is not proposing any structural changes for the site, he plans on cleaning up and re-painting. The bar area will remain the same. Mr. Upperpalli stated that the occupancy for the site is 160 people and he does not plan to expand beyond that capacity. Commissioner Martin stated that there are 94 seats in the restaurant, not including the bar and the application states there are 51 parking spaces available. Mr. Upperpalli stated that he only counted the parking spaces in the front of the building but there is shared parking with the hotel, also on this site. Mr. Patel added that all employee parking is in the rear of the hotel. Attorney Caponera stated that this site is approved for a restaurant use with the current parking and therefore the parking requirement so long as there are no changes in the preexisting use is allowed. Commissioner Martin asked if any other permits are required to open this business. Mr. Upperpalli stated that he will apply for a liquor license and Albany County Health Permit, both of which require local municipal approval first. Commissioner Hart seconded the motion. VOTE: Unanimous to approve the application as presented. Commissioner Martin made a motion to adjourn the meeting. Commissioner Chudzinski seconded the motion.
