Mayor Tobin opened the meeting of the Mayor and Board of Trustees at 6:30 p.m. with the Pledge of Allegiance. Roll Call: Mayor Tobin Present Deputy Mayor Sim Present Trustee Lockart Present Trustee Rubino Present Trustee White Absent Clerk Blot Present Attorney Ben Neidl Present Minutes of the regularly scheduled board meeting that was held on July 6, 2021, were reviewed by the present members of the board. The South Colonie School District made a presentation regarding property located and known as 96 Broderick Street, 96 A Broderick Street and 100 Broderick Street, located in the Village of Colonie. The School District intends to develop a portion of the 57 acres of land, for a operation/maintenance and transportation facility including bus storage, transport staff parking spaces, a district office/alternative education office, an athletic field with field parking and a possible walking trail. Superintendent of Schools David Perry was present to discuss the project. Attorney representative on behalf of the School District, Bill Ryan was also present. Superintendent Perry stated that based on the site size and location it is the perfect fit for the needs of the district. He feels that is benefits the school and the community. He added that the site has some identified wetlands, and the school district is working with the Pine Bush to ensure that those lands stay protected. Attorney Ryan mentioned that they are seeking a zoning exemption for the current area. The zoning in this area is conservation residential. He also noted that there is a portion of the parcel known as 100 A Broderick Street, which is in the Town of Colonie. He added that the Pine Bush has given a letter of support for the proposed development. Attorney Ryan sent a letter to Mayor Tobin dated July 9, 2021, requesting zoning exemption and stating some factors and notes of support for why exemption should be considered. Matt Schools gave an overview of the site map of the parcel drafted by the LA group. Mr. Ryan mentioned that this project involves many groups, but the School District is looking to be named lead agency in the development. Attorney Ryan stated that the move to the industrial park from the current bus garage location is a positive transition. Mr. Schools stated that he will be looking into the environmental impact statement for moving into the other location. Deputy Mayor Sim asked how far from the residential area backing the industrial park would the development be, to which Mr. School said the scale would indicate about 1,500 feet, but that is an estimate. Deputy Mayor Sim said the current location of the bus garage is very close to residential homes and has been for a long time, it will be nice to relocate that operation into the industrial park. Mr. Schools said that the Pine Bush is very mindful of the endangered species located in the area and Patroon Creek is another major factor in that area. Mayor Tobin asked which agencies were involved to which Mr. School stated the following agencies: Village of Colonie including boards and commissions, Town of Colonie including boards and commissions, Albany County including boards and commissions, Pine Bush, Army Core of Engineers, Department of Environmental Conservation and the South Colonie School District. Mayor Tobin asked if there would be a traffic study conducted, to which Mr. Ryan said it would be done as part of the long form of the environmental impact study. Deputy Mayor Sim asked if the LA group would be conducting any environmental studies that would need to be done, to which Mr. Ryan stated they would be put out for a coordinated review. Attorney Neidl stated that ultimately if there are multiple agencies that want to be lead, DEC would ultimately decide who the lead agency would be. Deputy Mayor Sim asked if there is a time frame for the decision of zoning exemption, to which Mr. Ryan said the final due diligence review is due October 14, 2021, but he believes the seller would have no objection to an extension and added the seller is very supportive of this development. Trustee Lockart voiced her concerns with the emergency access road onto Broderick Street as depicted on the draft site drawing. Trustee Rubino also mentioned his concerns with traffic in the residential neighborhood and asked who would have access to the emergency road, to which Superintendent Perry stated policy, fire, EMS and anyone with an authorized badge would have access to the road. The Mayor and Board thanked the School District for their presentation and requested time to review the proposal. The Clerk requested a vote for Resolution 2021-46 “Establishment of an account at First National Bank of Scotia to be named “American Rescue Plan Act Fund” and transfer of funds to said account once received”. A motion was made by Trustee Lockart to approve Resolution 2021-46, as presented. Motion seconded by Deputy Mayor Sim. The Clerk requested authorization to advertise to received bids for the 2021 Cleaning Bid contract, bids to be received on Friday, July 30, 2021, at 10:00 a.m. at Village Hall, 2 Thunder Road, Albany, NY 12205. A motion was made by Deputy Mayor Sim to authorize the Clerk to advertise, as stated above. Motion seconded by Trustee Lockart. The Clerk requested authorization to advertise for a public hearing to be held on Monday, August 2, 2021, at 6:30 p.m. at Village Hall, 2 Thunder Road, Albany, NY 12205, regarding Resolution 2021-48 “Establishment of Capital Reserve Fund – Village Hall” and Resolution 2021-49 “Establishment of Capital Reserve Fund – Recreation Center”. A motion was made by Trustee Rubino to authorize the Clerk to advertise, as stated above. Motion seconded by Trustee Lockart. VOTE: Trustee Lockart Yes Trustee Rubino Yes Deputy Mayor Sim Yes Mayor Tobin Yes Motion passed. Clerk Blot read aloud a letter from Susan Bredice stating she would be retiring on August 4, 2021. Mr. Gariepy of 587 Sand Creek Road was present to discuss some concerns with traffic, especially large trucks, and surrounding property maintenance issues in his neighborhood. Mr. Gariepy also mentioned that National Grid fixed a gas leak, and the blacktop repair job is uneven and needs addressing. Deputy Mayor Sim stated that National Grid stated that the blacktop repair was a temporary patch and that they would be back in 1-2 weeks to do a permanent fix. He stated he would follow up with the National Grid representative and get back to Mr. Gariepy. Mayor Page 3 of 4 Tobin stated that Code Enforcement sites people who are in violation of property maintenance issues and there is a process that is followed from that point. Ultimately if the owner does not comply, the violation will end up in court. Deputy Mayor Sim encouraged Mr. Gariepy to contact the policy regarding the large trucks because there is a weight limit on Sand Creek Road, to which Mr. Gariepy said he has reached out to them. Mr. Gariepy expressed how he would like to have a 3-way stop put in at Hunting Road and Sand Creek Road. Deputy Mayor Sim stated that the Village hopes to do a corridor study on Sand Creek Road to get a plan of what will become of Sand Creek Road in the future and would like to wait to see what the study shows before doing anything that would conflict with what the study may suggest to do. Mr. Gariepy also noted that he has seen the lawn signs and would like to have some placed on his lawn. Deputy Mayor Sim mentioned that is a program put on by our Traffic Advisory Committee and that Clerk Blot will pass his information onto the Traffic Committee coordinator to arrange for delivery of a sign.
