LEAK TRUSTEE JACK MURPHY MAYOR TRUSTEE jblot@colonievillage.org www.villageofcolonie.org JAMIE BLOT CLERK Public Hearing Local Law #1 of 2018 A LOCAL LAW ADDING CHAPTER 133: HOTELS AND MOTELS TO THE VILLAGE OF COLONIE CODE MONDAY, AUGUST 20, 2018 6:15 P.M. Mayor Leak opened the public hearing at 6:15 p.m. Clerk Blot read aloud the public notice as is appeared in the newspaper. Mayor Leak asked Attorney De Cotis to elaborate. Attorney De Cotis stated that this Local Law is modeled after the one that the Town of Colonie adopted a few years ago. The Town has had this code in place for several years and it seems to be working. Article 1 of the Chapter involves the registration of sexual offenders and Article 2 of the Chapter involves occupancy with regards to length of stay. Trustee Tobin added that he asked Clerk Blot to email the proposed Local Law to the members of the Planning Commission and Zoning Board of Appeals. Chairman of the Planning Commission, Chris Dennis was present and stated that he had no comments or concerns from any of his members. Resident Mike Capitula of Nicholas Drive was there to show his support for the Local Law. Mr. Capitula asked that since we don’t have a police unit how would the enforcement portion work. Attorney De Cotis explained that under the proposed law the enforcement officer has the rights to inspect and enforce the law. Mayor Leak added that he has a great relationship with the Town of Colonie police chief, and that the police department is always cooperative in times of need. Resident Joe Bianchini of Mordella Road was also present to show his support of the Local Law. Mr. Bianchini also mentioned some concerns he has with the condition of the Red Carpet Inn hotel, located behind his property. He said he talked to Code Enforcement Officer Rivera regarding his concerns but wanted to let the board know that nothing has been done yet with the property. Mayor Leak asked liaison Murphy to talk with Code Officer Rivera and Code Officer Cerone regarding the property first thing in the morning. Chief Kayser expressed his support for this proposed local law. He applauded the board for their attention to this issue. He said that they are constantly getting vagrants walking in to the fire house from Central Avenue. He added that the volunteers should not be subjected to the concerns/issues that some of these vagrants bring. A motion was made by Trustee Sim to close the public hearing.
