1. Consider approving the proposed collective bargaining agreement
between the Town and CSEA (Highway Department) for the period of
January 1, 2026 to December 31, 2027, as recommended by the
Comptroller.
2. Consider adopting the proposed resolution in support of the Harriet
Tubman Underground Railroad Byway.
3. Consider extending Local Law No. 1 (Moratorium on Certain Battery
Energy Storage Systems) by four additional months from September 20,
2026 to January 20, 2027.
4. Consider scheduling a public hearing for September 15 at 7pm on the
proposed local law that imposes a six-month moratorium on data centers.
5. Consider accepting and scheduling a public hearing for September 15
at 7:30pm on the proposed rezoning of property located at 761 County
Line Road from R40 to RA3, as recommended by the Town Planner.
6. Consider adopting the proposed resolution approving the
Comptroller's audit findings and recommendations for the annual court
records and financial documents submitted by the Town justices for year
ending December 31, 2025, as requested by the Deputy Comptroller.

The applicant is proposing an 18 unit townhouse style residential facility,
independent living facility on 1.4 acres of land located in the Local Business
(LB) District. The Zoning Board of Appeals approved an area variance for
setbacks at their March 4, 2026 meeting. The application was last reviewed at
the June 24th, 2026 Board meeting where the Board issued classified the action
as Type II.
4. DECISION ONLY. Consideration of Amending a Previously Approved Final
Plat (Brenn-Breit Estates Cluster Subdivision) - Fuller Station Road - Richard
Theriault
Continued from the May 27, 2026 Planning Board meeting. The Brenn-Breit
Estates Final Plat was approved by the Planning Board on July 24, 2002. The
current owner of Tax ID# 27.00-1-43.19, a 1.23 acre parcel in the R40 District,
was identified on the final plat with a note that states "Not an Approved Building
Lot. If purchased, lot must be consolidated with existing parcel of adjacent
owner." The current owner is requesting to remove the note and allow a
single-family home to be constructed on the lot.
5. Polsinelli Estates Concept Plan Review - 17 Lot Major Cluster Subdivision -

Continued concept plan review from the June 24th Planning Board meeting. In
2025 the applicant previously proposed a 15 lot subdivision. The applicant is
proposing a 17 lot cluster subdivision (16 single-family lots, one stormwater lot)
on 21.9 acres of land located in the RO30 District. A total of 9.37 acres of land

will be deed restricted open space. The parcel is located within the Albany Pine
Bush Preserve Management Area, with a recommendation of Partial Protection.
Lot sizes range from 16,548 square feet (0.38 acres) to 37,950 square feet (0.87

6. Site Plan Review Associated with a Special Use Permit (Pilates & Personal
Training Studio) - 1434 Western Avenue - Clare Vaughan & Brandon Sesay
The applicant is proposing a pilates and personal training studio within an
existing 10,080 square feet building located on 0.32 acres in the BNRP District.
The existing building consists of 8,030 square feet of commercial space and 2,
050 square feet of residential space. The Planning Board previously reviewed a
site plan for a proposed co-works office use on this property in November 2025,
which is no longer being pursued. The site plan report to the Zoning Board for
the co-works use is part of the agenda materials.
7. Site Plan Review Associated with a Special Use Permit - Residential Facility,
Independent Living - West Old State Road Tax ID# 27.19-1-5.3 - Serafini
Builders, Inc.
The applicant is proposing a 12 unit residential facility, independent living
project consisting of three buildings with 4 units in each building on 1.37 acres
located in the BNRP District. A garage space will be provided for each unit.
This will be a project update from when the Board last reviewed the application
at the January 8, 2025 meeting.
