Press Conference, Monday, November 21, 2005 6:30 PM

WHEREAS, The Common Council recognizes that the City of Albany Pine Bush is a
unique and endangered natural resource and seeks to protect and preserve this
important natural resource, and

WHEREAS, Pursuant to Article 46 of the New York State Environmental Conservation
Law, the Common Council, as the local legislative body for the City of Albany,
is authorized to dedicate public lands to the Albany Pine Bush Preserve for the
purpose of its protection and management, and

WHEREAS, This dedication does not transfer title, or affect ownership of the
parcels so dedicated, but provides the Albany Pine Bush Preserve Commission with
the authority to perform habitat management of these properties, pursuant to
Article 46 of the New York State Environmental Conservation Law, and

WHEREAS, According to the Revised February 4, 2000 “Third Supplemental
Final Environmental Impact Statement P-4 Project Landfill Expansion City of Albany” adopted
by the Common Council on March 20, 2000, the City of Albany was required to,
upon issuance of the permit for the P-4 Project, acquire the option, held by
the Nature Conservancy, for the 60 acre site immediately north of the Rapp Road
Landfill with dedication of the undeveloped portion (approximately 40 acres)
to the Albany Pine Bush Preserve Commission upon closing.

NOW, THEREFORE, BE IT RESOLVED, That the City owned parcels acquired from the
Nature Conservancy and as described in the Revised February 4, 2000 “Third
Supplemental Final Environmental Impact Statement P-4 Project Landfill Expansion
City of Albany” are hereby dedicated to the Albany Pine Bush Preserve Commission
for management purposes.
